PUBLIC CONTRACT for the provision of medical services(entered into force on 01.11.2024)

1. GENERAL PROVISIONS 1.1. INDIVIDUAL ENTREPRENEUR VADIM VALERIYEVICH BOLSHUNOV (hereinafter referred to as the “Contractor”) and an individual who has applied to the Contractor for medical dental services (hereinafter referred to as the “Patient”), together referred to as the “Parties”, and each individually as a “Party”, have entered into this agreement on the following.This public agreement is addressed to all consumers who wish to use medical services and have the opportunity to receive services. Pursuant to the provisions of Articles 633, 634, 641 of the Civil Code of Ukraine, the terms of the public contract are the same for all consumers (hereinafter referred to as Customers (“Patients”).
1.2. Carefully read the text of this Agreement and if you do not agree with its terms and conditions or any other clause of its terms, the Contractor offers you to refuse to enter into the Agreement and use the services of the Contractor. 2. TERMS AND DEFINITIONS2.1. For the purpose of this Agreement, the following terms shall have the following meanings:● “Services” - the provision of full medical care in accordance with the list of medical services of the Contractor.● “Customer” (“Patient”) - an individual who has applied to the dental office of the Contractor for medical dental services and has concluded an agreement with the Contractor for the provision of such services. If the consumer of the Services is a minor or incapacitated person, the rights and obligations provided for in this Agreement for the Patient shall be acquired by the legal representative. ● The “Contractor” is a business entity, individual entrepreneur Vadym Bolshunov, who provides services in the field of medical services.
2.2. This Agreement may use terms not defined in clause 2.1. In this case, the interpretation of such term shall be made in accordance with the text of this agreement. In the absence of an unambiguous interpretation of the term in the text, the interpretation of the term should be guided by the interpretation of the term: first of all - on the Contractor's website, secondly - on the Internet.
3. SUBJECT OF THE CONTRACT3.1. The subject matter of the Agreement is the provision of medical services to the Customer in accordance with the terms of this public agreement according to the list:● dentistry● therapeutic dentistry● orthopedic dentistry● surgical dentistry● orthodontics● radiology,● nursing
3.2. The Public Agreement is an official document and is published on the website at: www.311dental.com.ua and in a publicly accessible place at the Contractor's premises at the following address: 17-B Andriy Verkhoglyad Str., Kyiv, Ukraine, room.
4. COST OF SERVICES AND PROCEDURE FOR SETTLEMENTS UNDER THE AGREEMENT4.1. The cost of the service is determined individually depending on the scope of work, is formed on the basis of the Contractor's Price List posted on the website www.311dental.com.ua and in a publicly accessible place in the Contractor's premises at the address: Ukraine, Kyiv, Andriy Verkhoglyad Str., 17-B, room.4.2. The Contractor has the right to change the Price List, the terms of this Public Agreement without prior agreement with the Customer, ensuring that the amended terms are published in a place publicly available for familiarization with these documents, at least one day before their entry into force.4.3. Payment for the Contractor's services shall be made by the Customer by means of a bank payment card or by depositing cash at the cash desk. Payment for services exceeding UAH 50,000.00 (fifty thousand) shall be made by bank transfer by transferring funds to the Contractor's current account.4.4. The services provided under this Agreement may be paid for the Patient by another individual or legal entity under the simplified taxation system.4.5. Payment for the Services rendered to the Customer shall be made on the basis of 100% payment for the Services performed immediately after their performance. The Customer has the right to make an advance payment for the Services.4.6. Payment for orthopedic Services is made on the basis of 50% prepayment or as agreed by the parties.4.7. Payment for treatment with the use of dental implants and bone plastic surgery is made by 100% prepayment on the day of surgery.4.8. If the Customer refuses from the Services for implant placement or bone plastic surgery, the cost of implants, bone plastic material and insulating membranes purchased for him/her shall be reimbursed at 100% of the cost price.4.9. The preliminary cost of the Services is indicated in the Treatment Plan and does not include the cost of treatment of hidden pathologies that may be detected during treatment. The Treatment Plan and the cost of permanent orthopedic work are agreed upon only after the complete completion of therapeutic, surgical and orthodontic treatment.4.10. The rules for the provision and payment of medical services are posted on the website and in a publicly accessible place at the Contractor's premises at the following address: 17-B Andriy Verkhoglyad Str., Kyiv, Ukraine, room 3.5. RIGHTS AND OBLIGATIONS OF THE PARTIES 5.1. The Contractor shall:● The Contractor's medical staff shall have appropriate special education and meet the uniform qualification requirements in accordance with the legislation of Ukraine.● Conduct a qualitative examination of the Customer's oral cavity and, if necessary, offer him/her to undergo additional consultations and examinations by specialists of other medical specialties in order to clarify the diagnosis, the correct choice of materials and methods of treatment or prosthetics.● Based on the results of the examination, provide the Customer with complete and accurate information about the condition of his oral cavity, the nature of the treatment methods, prosthetics, medicines, and materials used in his case.● Prior to the start of medical services, the Contractor shall verbally inform the Customer of the list, composition and cost of all medical services that it considers appropriate. At the request of the Customer, a written Treatment Plan may be drawn up.● Determine for the Customer the warranty period for the services rendered, explaining the conditions under which the warranty obligations are maintained and indicating the warranty period in the Act of Work Performed. If it is impossible to provide a warranty, the warranty period shall not be specified in the Certificate of Completion.● When providing paid medical services, comply with medical formularies, standards of care and/or local/clinical protocols of medical care approved by the Ministry of Health of Ukraine.● Inform the Customer about the circumstances that may lead to an increase in the scope of services, possible complications during treatment, and temporary discomfort that may arise during treatment and prosthetics (Annex 1).5.2. The Contractor has the right to:● Independently determine the nature and scope of treatment, manipulations and techniques necessary for the treatment of the Customer within the treatment plan.● Refuse to admit the Customer in cases of alcohol or drug intoxication and when the Customer's actions threaten the life and health of the Contractor's staff.● To refuse to provide the Services at any time (provided that such refusal does not threaten the Patient's life) in the following cases:▪ provision by the Patient of incomplete and/or inaccurate data about his/her identity and/or health status;▪ medical contraindications to undergoing treatment by the methods determined by the Parties;▪ refusal of the Patient to undergo examinations necessary for further treatment;▪ in case the Patient insists on using medicines or applying diagnostic and treatment methods that are not authorized for use in Ukraine;▪ failure of the Patient to comply with the prescriptions or treatment schedule established by the attending physician;▪ violation by the Patient of the Rules of Stay and Patient Care.

5.3. The Customer is obliged to:● Strictly adhere to all prescriptions and recommendations of the Contractor to achieve and maintain treatment results.● Provide the Contractor with the information necessary for the Contractor about his/her health status, past and present diseases, surgeries, injuries, previous examinations and treatments, allergic reactions and contraindications, as well as other information that may affect the quality of the services provided by the Contractor.● Immediately report any complications or abnormalities that occurred during treatment, and in case of emergency dental care in other medical institutions, provide an extract from the medical record, X-rays, and the results of examination and treatment.● In case of an emergency, the Customer has the right to seek help from other medical institutions only after prior notification of the Contractor.● In case of receiving dental services with the use of dental implants and bone and plastic surgeries, the Customer should read Annex 2, Annexes 2.1, 2.2, 2.3, 2.4.● In case of receiving Surgical Dentistry Services, the Customer shall familiarize themselves with Appendix 2.2.● Appear on time for medical and subsequent preventive appointments, and if you cannot attend for a valid reason, notify the Contractor as soon as possible.● The customer must appear for preventive maintenance once every 6 months, in case of failure to appear, the warranty obligations are canceled.● Pay for the services of the Contractor under the terms of this contract and comply with the Institution's internal regulations.5.4. The Customer has the right to.● choose a doctor (clause 2 of Article 284 of the Civil Code of Ukraine; Article 34 of the Fundamentals of Healthcare Legislation)● refuse treatment at any stage (part four of Article 284 of the Civil Code of Ukraine), but subject to full payment for the services performed. 6. TERMS AND CONDITIONS OF SERVICE PROVISION6.1. The Contractor shall provide services under this Agreement on the days and hours of operation, which are set by the Contractor's administration and communicated to the Customer on the website at www.311dental.com.ua or in a publicly accessible place in the Contractor's premises at the address: 17-B Andriy Verkhoglyad Str., Kyiv, Ukraine, room 3.6.2. Medical services are provided by appointment by calling +38 068 311 0 311 and via the Internet.6.3. The Contractor reserves the right to change the time of service provision by prior agreement with the Patient, as well as the right to admit the Patient with symptoms of an acute illness out of turn.6.4. The quality control of medical care shall be carried out in cases, in accordance with the procedure and within the time limits provided for by the legislation of Ukraine.6.5. The quality of medical services provided must meet the requirements of the legislation of Ukraine. Acceptance and transfer of medical services provided shall be carried out by drawing up an Act of Work Performed, which shall be drawn up in two copies and signed by the parties.6.7. The Patient is obliged to sign both copies of the Statement of Work performed or provide a written reasoned refusal to sign the Statement.6.8. If the Patient has not provided the administrator with a written reasoned refusal to sign the Act of Work Performed, the medical service shall be deemed to have been properly provided and duly accepted by the Patient.6.9. In the presence of a written reasoned refusal to sign the Act of work performed, the Contractor within 14 (fourteen) calendar days shall consider such a refusal and notify the Patient in writing of the results of the review.6.10. The terms of provision and performance of services are specified by agreement with the Customer, taking into account the patient's somatic and psychophysical condition, the severity of the clinical situation, the characteristics of the disease, etc. The number of appointments (sessions) is determined individually, agreed upon by both parties, and recorded in the treatment plan (Article 15 of the Law on Consumer Protection).
7. WARRANTY OBLIGATIONS 7.1. In case of providing medical services to the Patient, the Contractor undertakes to fulfill the following warranty conditions:● For fillings, a warranty is provided for one (1) year from the date of provision of the relevant services;● The warranty for crowns, one-piece, metal-ceramic, metal-free is 1 (one) year from the date of provision of the relevant services;● The warranty for removable dentures (clasp, nylon), steel crowns, implant crowns is 1 (one) year from the date of the relevant services;● Warranty for dental services with the use of dental implants and bone and plastic surgeries is determined individually, agreed and signed with the Patient.7.2. The warranty is not provided:● in case of simultaneous treatment in another dentistry without prior notification of the doctor and a corresponding entry in the medical record;● in case of any independent intervention of the patient in the dental structure● in case of complications arising from the patient's failure to appear at the time specified by the doctor or due to non-compliance with medical recommendations and prescriptions;● in case of loss of the orthopedic structure, when it is cemented.● for the repair of dentures, removable lamellar dentures, plastic crowns.7.3. For smokers, as well as those who abuse coffee, tea, red wine and other products containing high concentrations of organic dyes, the warranty for color preservation during cosmetic photopolymer restorations and whitening procedures is 1 (one) week from the date of provision of the relevant services by the Contractor.7.4. In case of an unsatisfactory oral hygiene index, depending on its value, the warranty for all work may be partially or completely revoked, and a corresponding entry is made in the Patient's medical record.7.5. Treatment must be completed in full in accordance with the treatment plan. If the treatment is not completed and carious teeth, old failed fillings and orthopedic structures that are a constant source of cariesogenic infection and require replacement are left, the warranty period for all work performed is reduced by half.7.6. In the event of problems with any dental structure, the patient is obliged to notify the Contractor within 7 (seven) calendar days inclusive and to contact the Contractor as soon as possible within the time limits determined by the doctor after his notification. In case of untimely application and long-term postponement of the application due to the Patient's fault, the guarantee is not provided.7.7. In case of the patient's absence or the Customer's appeal to another medical institution, or in connection with non-compliance with medical recommendations and prescriptions, the warranty obligations are canceled.7.8. The warranty does not cover cases of consequences of injuries and diseases that have led to dental system disorders (fractures of teeth and jaws, facial bones, severe systemic diseases, radiation and chemotherapy, surgical interventions, etc.).7.9. No warranty is provided for any work on teeth whose canals were previously treated by the Contractor. The treatment of such teeth is a very risky and unpredictable process. Root canal retreatment is one of the most expensive and resource-intensive manipulations. If the result of the treatment is not positive and the tooth is removed, the Contractor shall not refund the money for the treatment and prosthetics of this tooth.7.10. If the Patient provides inaccurate information when filling out medical records, the Contractor has the right to refuse the Patient a guarantee for the services performed or to reduce its validity.7.11. The warranty periods may be set by the Contractor's doctors individually for each type of dental services, which must be notified to the Patient under the signature in the Informed Consent and a corresponding entry must be made in the medical record. These terms, depending on the clinical situation, may differ from the standard warranty terms accepted by the Contractor.7.12. In the event of a warranty situation, poor-quality orthopedic work, lost implants, etc. shall be returned to the Contractor.7.13. The warranty does not cover normal wear and tear or damage caused by abnormal or improper use, negligence or accident.7.14. The warranty does not cover endodontic treatment.7.15. No refunds will be made for orthodontic and orthopedic constructions that are made individually for a particular Patient.
 8. RESPONSIBILITY OF THE PARTIES8.1. In case of violation by the Customer of its obligations (clause 5.3. of the Agreement), the Contractor shall disclaim any liability for possible consequences or complications arising from the Customer.8.2. In case of the Customer's absence for more than a week (from the appointed date) during the production of orthopedic work, the Contractor shall disclaim any liability for possible deformation of the work or changes in the conditions of fixation in the Customer's oral cavity. In this case, the Customer is obliged to compensate the Contractor 50% of the cost of the work.8.3. In all other cases, the parties shall be liable in accordance with the applicable law.
 9. ADDITIONAL TERMS AND CONDITIONS9.1. The Agreement shall be deemed concluded without its further signing from the moment of the Patient's oral or written request for medical dental services or other actions provided for by the Agreement, which indicate the consent to comply with the terms of the Agreement (signing a treatment plan, informed consent to diagnosis and treatment, the beginning of the actual use of services, payment of the Contractor's invoice, etc.9.2. If the Customer refuses to receive medical services after the conclusion of the Agreement, the Agreement shall be terminated. In this case, the Customer shall send a written notice of termination to the Contractor and pay the Contractor 100% of the actual costs incurred in connection with the performance of this Agreement. If 75% or more of the services have already been performed, the Customer has the right to terminate the agreement only in respect of the part of the services that have not yet been performed (Article 10 of the Law on Consumer Protection).9.3. On the basis of clause 2, Article 10 of the Law of Ukraine “On Electronic Commerce”, the Customer agrees to receive SMS messages and e-mails of the Contractor's marketing campaigns and other information (reminders of appointments, invitations to preventive examinations, etc.) as part of the Contractor's services.9.4. The Customer may refuse to receive SMS and e-mail newsletters specified in clause 9.3. of this Agreement by contacting the Contractor's administrator by phone or at the address specified in the Contractor's details during the Contractor's working day.9.5. The Customer does not object to taking photos and videos during treatment, as well as to the use of these materials for scientific and advertising purposes without indicating personal data and facial images.9.6. The Customer is informed that the Contractor's premises are under video surveillance.9.7. By joining this agreement, on the basis of Article 11 of the Law of Ukraine “On Personal Data Protection”, the Customer decides to provide his personal data to the Contractor, and agrees to their processing by maintaining automated databases, mechanically and manually. The list of personal data to which the consent is given: surname, name, patronymic, gender, date of birth, home and mobile phones, place of work, health data, adverse reactions, place of residence and other personal data received by the Contractor in the provision of medical care.9.8. The Contractor shall not disclose to third parties information about the disease, medical examination, examination and their results, intimate and family aspects of the Patient's life, which became known to him/her in connection with the performance of this Agreement, except as provided by the legislation of Ukraine and other agreements, including voluntary health insurance.9.9. In accordance with Art. 43 of the Law of Ukraine No. 2801-XII of 19.11.1992. “Fundamentals of the Legislation of Ukraine on Health Care”, the Customer gives his/her Informed Consent to diagnostics, treatment, surgery and anesthesia (Annex 3).9.10. The medical record of the dental patient is a part of the Agreement.9.11. The Customer is informed that the Contractor does not participate in the implementation of the program of state guarantees of free medical care to citizens.9.12. In case of discrepancies between the terms of this Agreement published on the official website of the Contractor and in hard copies at the Contractor's premises, the hard copy shall prevail.9.13. The parties shall seek to resolve all possible disputes arising in the course of performance of this Agreement through negotiations, and in case of failure to reach an agreement - in court.

Annex 1 to the Public AgreementPossible complications during dental procedures Individual entrepreneur Bolshunov V.V.Kyiv, _________ 20__.When performing injection anesthesiaLocal injection anesthesia is intended to anesthetize medical manipulations. Local injection anesthesia is performed in the area of manipulation and involves one or more injections (shots) to administer an anesthetic substance to provide anesthetic effect. The duration of the effect can vary from 15 minutes to several hours, depending on the type of anesthetic and individual sensitivity of the body.The use of local anesthesia can lead to allergic reactions to medications, fainting, collapse, shock, trauma to nerve endings and blood vessels, manifested by loss of sensitivity, neuritis, neuralgia and post-injection hematomas.The main complications of injection anesthesia are primarily due to the introduction of a special solution into the body tissues and the body's reaction to it (increased heart rate, increased blood pressure, allergic shock, fainting, collapse). The solution is injected using a needle, which injures soft tissues and can cause internal bleeding and hematoma, swelling of the gums in the injection area, trismus (limited opening of the mouth), which can last for several days or longer. Anesthesia is complicated in case of severe stress, in the area of existing inflammation, in the area of the lower jaw molars, after the use of alcohol or drugs. When performing local injection anesthesia, the result is not guaranteed, but it is guaranteed that the treatment is carried out by a specialist of appropriate qualifications, using high-quality materials and instruments in compliance with the relevant methods and rules of the sanitary and epidemiological regime.In the treatment of deep cariesThe treatment of deep caries is aimed at preserving the viability of the tooth pulp, but nevertheless, the manipulation can lead to the following complications● pain may occur, and the doctor will have to perform endodontic treatment;● pain may occur in a more distant period, which will also lead to endodontic treatment;● if complaints are ignored and the schedule of control examinations with X-ray examination is violated, pulp necrosis with inflammation of the periradicular tissues - periodontitis - may be detected in the future.In case of complications, endodontic treatment is carried out at the patient's expense.During endodontic treatment (root canals)Endodontic treatment involves opening the cavities of the root system, their mechanical and medicinal treatment for disinfection, as well as permanent root canal filling to ensure a stable long-term result. The positive result of endodontic treatment in the form of disappearance of inflammation in the area of the root apex is manifested in the period from 3 to 12 months. Although endodontic therapy has a high percentage of clinical success, it is a biological procedure and therefore cannot be guaranteed to be successful. Treatment complications and consequences are possible:● discomfort after the treatment, which lasts from several hours to several days, for which the doctor may prescribe medications if he/she deems it necessary;● during the treatment of root canals, especially curved root canals, it is possible that the instruments may break, which may result in the inability to remove them from the root canal, or the instrument may pierce the root wall. Although this is rare, such complications can cause endodontic treatment to fail and can lead to tooth loss or require other manipulations;● in some cases, it becomes impossible to remove the old root filling and foreign body during root canal retreatment, and especially when the root canal is passed to the full working length in the roots of teeth treated previously with the resorcinol-formalin method;● during the treatment of perforations, symptoms of subcutaneous emphysema may appear;● when rinsing root canals with antiseptic solutions, soft tissue edema in the area of the causative tooth may occur;● endodontic intervention may exacerbate the chronic process and cause pain in the tooth when biting and chewing;● if it becomes necessary to treat the root canals of a tooth covered with a single crown or which is the support of a fixed prosthesis, then when creating access to the root canals of this tooth and isolating it with a cofferdam, the orthopedic structure may be damaged, or it may be necessary to remove the entire orthopedic structure (in this case, its permanent deterioration is also possible). Also, when trying to remove the orthopedic structure, the tooth itself may fracture, which may lead to its extraction;● even with the successful completion of endodontic therapy, no guarantee can be given that this tooth will not undergo carious decay and fracture in the future.When root canals are re-treated, the success rate of endodontic treatment decreases due to: the inability to remove the old root filling or metal pin from the root canal; poor root canal patency, which increases the likelihood of various complications (perforations, instrument breakage).All these complex clinical situations can affect the final result of endodontic therapy. After endodontic treatment, there is a need for mandatory tooth restoration. After root canal treatment, the tooth will be more fragile and, at the doctor's discretion, it will need to be protected from fracture by installing a crown (inlay).When treating root canals, the result is not guaranteed, but it is guaranteed that the treatment is carried out by a specialist of appropriate qualifications, using high-quality materials and instruments in compliance with the relevant methods and rules of the sanitary and epidemiological regime.
When whitening teethSignificant whitening can be achieved in most cases, but a certain result cannot be guaranteed.Whitening, like many other procedures, has some risks and limitations. To achieve the desired result, this procedure can be performed in one/two or more visits, depending on the type of teeth. Each visit will take about an hour.In the case of clinical whitening in more than one visit, the break between procedures can be from one to two weeks. If more than two weeks pass, the results may be less effective because the effectiveness of the procedure will be lost.During the first 24 hours after whitening, tooth sensitivity may be increased. This sensation usually goes away within 1-2 days, but sometimes it can last longer. If the increased sensitivity does not go away, the doctor may suggest a procedure to reduce sensitivity for an additional fee. In the case of initial tooth sensitivity, the doctor may also perform procedures to reduce sensitivity to whitening by agreement.Whitening can cause temporary inflammation of the gums. Gum irritation may also occur. These problems go away within a few days.Carious cavities and/or loose restorations should be closed and/or replaced before bleaching. After bleaching, it is possible to correct the color of the restorations (up to complete replacement of the restorations) to match the new color of the teeth.
It is impossible to predict exactly what color the teeth will be after whitening. During and after the procedure, the condition may change, then at the discretion of the doctor, additional or alternative therapy may be prescribed to achieve a favorable result. For additional activation of the gel during the procedure, a light source is used. If the Customer has melanomas or is undergoing chemotherapy, he/she should consult a therapist and an oncologist before bleaching. Also, if the Customer is taking any photosensitive medications, they should consult a doctor to avoid a photoreaction.After the whitening procedure, it is recommended to stop smoking and excessive consumption of colorful food, coffee and other drinks containing dyes, otherwise the whitening procedure will be ineffective.When providing the whitening procedure, it is guaranteed that the treatment is carried out by a specialist with appropriate qualifications, using high-quality materials and instruments in compliance with the relevant methods and rules of the sanitary and epidemiological regime.During orthopedic treatmentOrthopedic treatment is aimed at long-term replacement of dentition defects, improvement of chewing function and/or aesthetic rehabilitation.After orthopedic treatment, it may be difficult to adapt to dentures, feel nauseous, have impaired speech, chewing, swallowing, and denture breakage.In the presence of dissimilar metals in the oral cavity, galvanic currents can occur, resulting in a burning sensation, soreness, redness and swelling of the oral mucosa.During surgical treatmentThe main complications of surgical treatment are primarily due to individual anatomical features of the body. Surgical treatment in the upper jaw area is performed in close proximity to the maxillary (maxillary) sinus. In case of perforation of the sinus floor, inflammatory complications in this area are possible. During the consultation of the Customer and planning of implant treatment, the Contractor provides detailed information about the method of dental implantation, prognoses, possible consequences and complications of this type of treatment.3. Dental treatment with the use of dental implants consists of two main stages: the first is surgical (implant placement), the second is orthopedic (implant-supported prosthetics).The terms of implant-supported prosthetics vary from 3 to 6 months after their installation (the period of osseointegration), depending on the anatomical and physiological characteristics and are determined individually in each case.
